Terms of use

Short, because there is not much to it. This site introduces a householder to a restoration company and takes no part in the work that follows.

What this site is

Oakland Summit Water Damage publishes information about water damage work in Oakland and the East Bay, and takes requests from householders who want a restoration company to look at a job. Using the site, or sending a request through it, means these terms apply to you.

This site does not carry out restoration work. It has no equipment, no crew and no premises. The company that contacts you is a separate business, and the agreement to do any work is between you and them, not between you and this site.

What we do not stand behind

Because we are not the company doing the work, we do not warrant that company's workmanship, their conduct, their pricing, their timekeeping or the outcome of the job. We do not promise that anybody will contact you, that they will take the work, or that any price you are quoted is a good one.

What you can do instead of relying on us is check them, which takes about a minute and is described on the questions page. California maintains a public register of contractor licences and it will tell you more than any assurance printed on a website.

Information on these pages

The pages here describe how water damage work is done and quote outside bodies where a figure or a rule comes from one. Each of those figures names its publisher and the date the publisher's page was read, and the publishers keep their own pages current while this one is a snapshot. Check anything you intend to act on at its source.

None of it is legal advice, insurance advice, or a professional opinion about your building. The claims page explains how a California residential claim is generally framed and it is not a reading of your policy. The sewer lateral page explains what the utility and the City require and this site neither inspects laterals nor issues certificates. The pricing page publishes figures other people have published and contains no quotation for your job.

Sending a request

Send accurate details, and send them about a property you own or occupy or are otherwise entitled to arrange work on. Do not use the form to send anything unlawful, anything automated, or anything about somebody else's house without their say-so. A request costs you nothing and commits you to nothing, and nothing about sending one obliges you to accept any quotation that follows.

Links to other sites

Pages here link out to public bodies and to other publishers where a claim rests on something they wrote. We do not control those sites, we are not responsible for what they say after we read them, and a link is not an endorsement of anything else on the site it points to.

The site itself

The text, layout, images and code on these pages belong to their owner and are not free to copy. The site is provided as it is, and while there is a genuine effort to keep it accurate, it may be unavailable, and it may contain a mistake. Where a mistake is pointed out it gets corrected.

To the extent the law allows, Oakland Summit Water Damage is not liable for loss arising from use of this site or from any dealing with a company introduced through it. Nothing in these terms limits any right you have under California consumer law, and where a clause here conflicts with that law, the law wins and the rest of these terms still stand.

Changes, and which law applies

These terms can change, and a change carries a new date at the top of this page. Continuing to use the site after that means the newer version applies to you. California law governs them, and the courts of Alameda County are where any dispute about them would be heard.
